Woman charged with tossing newborn had 2nd child die in 2008
Also of question is if the new mother was aware that the child was still alive when she tossed it and why for that matter she resisted disclosing she had just given birth?
A woman police believe threw her newborn daughter to her death from a seventh-floor window of a New York City apartment building has been arrested.
Local media report that the infant was found with its umbilical cord still attached after the horrific fall.
Giovanni Johnson, 28, who had been in a relationship with the 33-year-old for around a year and a half, said that he had been under the impression she’d had an abortion.
At Berry’s arraignment, a Bronx prosecutor said the 8-pound baby had drawn her first breath before she died.
Neighbors said they only saw Berry periodically in the building where she lived with the newborn’s father and a toddler from a previous relationship.
The infant was found at about 2:30 p.m. Monday by the wife of the building’s superintendent.
Ms. Berry was arraigned Tuesday evening on charges of second-degree murder and manslaughter. Berry claimed the baby was stillborn, but the autopsy confirmed she was alive at the time she was allegedly thrown. The spokesperson could not confirm if Berry left the job or if she was terminated.
An attorney for Berry, who is from Yonkers, did not immediately respond to a request for comment.
He told investigators he had no idea his girlfriend had given birth – or that she was pregnant at all.
Johnson is not faced with any charges as police have ruled out that he is involved in the crime that Berry committed. “There was air in the lungs, this was a healthy baby girl”, Barker said. New York City’s children services department has launched an investigation into the circumstances surrounding the child’s death.
