Aunt sues 12-year-old nephew for breaking her wrist
The aunt of a 12-year-old boy is suing her nephew for £84,000 after he jumped into her arms accidentally breaking her wrist as she cuddled him at his birthday party.
She said she didn’t want to hurt his feelings during his party, so she didn’t mention the injury at the time.
She is seeking $127,000 from the boy, who she described as always being “very loving, sensitive”, toward her. The boy is the only defendant in the case. The boy was playing outside on a new bike when he saw his aunt, dropped his bicycle and ran toward her, gleefully shouting, “Auntie Jen, Auntie Jen”.
“She said that she remembered him shouting “‘Auntie Jen I love you'” as he was “flying at me”.
Jennifer is asking six members of the Superior Court to find her 12-year-old nephew responsible for his 8-year-old actions of exuberance, reports the Connecticut Post. The boy lost his mother, Lisa Tarala, when she died past year.
Connell testified that she loved her nephew, but that he should be held accountable for her injury, which she claims upended her life.
The incident in question occurred March 18, 2011, when she came to Westport, Conn., to attend her nephew’s birthday bash.
Connell’s 50-pound nephew jumped into her arms, sending the two tumbling to the ground, she testified. “And we all know how crowded it is in Manhattan”, she told a Connecticut court on Friday.
Connell did not complain about the injury during the party, only addressing it now, four years later.
Connell, who has no children of her own, claims her life has not been the same since the incident.
There have also been ramifications to Connell’s social life.
“I was at a party recently, and it was hard to hold my hors d’oeuvre plate”, she told a told a Connecticut jury. The boy was reportedly acting “confused” while sitting in the court room, and did not give comments to any news outlets.
Her lawsuit alleges that as an eight-year-old Tarala was old enough to know better.
