Kim Davis’ Lawyers Argue Altered Marriage Licenses Are Valid
They’re urging Beshear to call a special session in order in that lawmakers can enact lodging for religious county clerks who refuse to bid marriage licenses for same-sex couples.
Kim Davis’ attorneys said Tuesday that the Kentucky clerk has taken reasonable steps to comply with a judge’s orders and should not be fined.
Davis spent five days in jail for refusing a federal judge’s order to issue the licenses.
She refused to issue any licenses after a U.S. Supreme Court ruling in June made gay marriage legal across the United States and she was sued by gay couples. Only a deputy’s name is on the form – and not his title – with a place for him to initial rather than to use his signature.
In response, Governor Beshear previously stated that all clerks should follow the law, “do their jobs” and issue the licenses without prejudice.
In an interview with TheWrap.com, Champion, who married husband Rubem Robierb in 2012, said that Davis did not have a right to impose her religious beliefs on others.
Almost a dozen Rowan County leaders want to meet with Governor Steve Beshear to ensure the disruption that happened in Morehead over same-sex marriage doesn’t happen again.
Those changes, the couples told the judge, were inconsistent with state rules for marriage licenses, raising potential questions about their validity.
“It has never really been about a marriage license – Rowan County has issued the licenses – it is about forcing their will on a Christian woman through contempt of court charges, jail, and monetary sanctions”, Mat Staver, a lawyer representing Davis, said in a statement.
