Ex-prosecutor who didn’t charge Cosby sued for defamation
Castor was the district attorney when former Temple University employee Constand first brought her allegations against Cosby, but he declined to file criminal charges against the scandal-plagued comedian.
The lawsuit claims Bruce Castor called Constand’s credibility into question and interfered with a 2015 investigation into her case with comments he made over the past month on various media.
Last week, Steele’s campaign began running ads challenging Castor’s decision not to prosecute.
Agents for Cosby, who starred as Dr. Cliff Huxtable on “The Cosby Show” from 1984 to 1992 and has been married for decades, have contacted defense lawyers this year to represent him in the reopened investigation.
In announcing he would not charge Cosby, Castor said that both parties could be portrayed in “a less than flattering light”. Troiani said. “I don’t know how we could possibly do that”.
Castor declined, saying there was not enough evidence. Castor says, “He has to try to do something to put himself in the same stages with me. The fact of the matter is it’s complete nonsense”.
Cosby is replacing his longtime lawyer in a sex abuse lawsuit filed by a woman claiming she was molested by the comedian in the 1970s when she was 15-years-old.
Constand accuses Cosby of drugging and sexually assaulting her. Cosby says his sexual relations with various women were consensual. Castor has defended his decision not to charge Cosby by saying Constand gave a less serious account to police than she described in her 2005 lawsuit.
The suit, filed Monday, accuses Castor of rendering her “collateral damage for his political ambitions”. “I’m a lawyer. I’m not afraid of court”. Castor left office in 2008 and, after pondering a run for statewide office, is now a county commissioner.
“In 7 days the people of Montgomery County will select their next District Attorney”.
Since then, the handling of Constand’s claims has emerged as a primary point of contention in the race between Castor, a Republican, and Steele, his Democratic opponent. The statute of limitations in this case will run out early next year.
“It is the act of a desperate candidate who is down in the polls and headed to defeat”, Castor said. It is totally without merit. Castor is now campaigning for his old job, and his opponent has raised the issue repeatedly. But there has been a steady demographic evolution, and the Democrats now have decided voter registration advantage.
