Kane turns over material to judge hearing Sandusky appeal
“The seriousness of this reckless breach of sealed Supreme Court documents, orchestrated by the presiding judge of a state investigative grand jury, with attorneys and the very reporters who have covered a few of the Sandusky, Computergate, and Bonusgate cases, can not be overstated”, Kane said in the statement.
Judge John Cleland ordered the attorney general to “clarify” comments she made about potential leaks involving the judge in the Sandusky grand jury investigation.
Cleland ordered Kane to disclose what she knew about leaks during a hearing last week on Sandusky’s request for subpoena power as he pursues an appeal of his 45-count conviction. According to the order, Kane responded to the judge’s original order, under seal, and said she has “no knowledge at this time of any email that proves such leak(s)”.
Judge Barry Feudale’s allegations Wednesday are his latest against Attorney General Kathleen Kane. He argued charges should be dismissed if the grand jury process is shown to have been unfair.
The order goes on to say her response does not appear to directly address the terms of the original order to disclose “any information of which she is aware to support her conclusion”. Kane told the Associated Press on September 30 she suspected Sandusky leaks may have come from within her agency. The release intimated that the grand jury that oversaw cases including Sandusky’s had been mixed up in Feudale’s impropriety.
