DraftKings tries to block daily fantasy sports ban in NY
FanDuel, based in New York, said on its website Friday that it would stop allowing new deposits from New York and will limit access to New York customers while the company pursues “the opportunity to be heard in court”.

In seeking the restraining orders, the companies said that Schneiderman’s office had been pressuring their vendors to stop doing business with them, and they could be forced to close up shop in the state. FanDuel has said it planned to pay out $2 billion in cash prizes this year.
Schneiderman has argued the games constitute illegal gambling in NY, and both companies have sued Schneiderman in an attempt to block his order.
Although Yahoo’s traditional fantasy leagues are open to players in any state, the company expressly prohibits would-be players in seven states – including Florida – from participating in its paid one-day or weekly fantasy sports games.

“A shutdown would have a chilling effect on Draft Kings’ ability to attract new investors and partners and would impede its ability to continue its relationships with its existing investors and partners”, the company state. Even though the businesses have “not operated in an entirely upfront manner” and the attorney general might have a valid consumer-protection complaint, she argued that DraftKings and FanDuel haven’t done anything that would warrant their immediate shutdown.

The company also is requesting an expedited hearing schedule.
The NY attorney general’s move is an outgrowth from a recent probe concerning allegations of insider trading, where a few employees at these sites were raking in big payments on their rival sites.
As a sidebar with Joe Namath defining both sites as a place where someone has to “pay to play” and can potentially win money in the process, the question of whether either site is entertainment or gambling was brought up.
