US marine guilty of killing transgender woman in Philippines
The DOJ cited as basis for the arrangement for the detention of Pemberton on a Supreme Court ruling in which Lance Cpl. Joseph Scott Pemberton outside the courts at Olongapo city, Zambales province, northwest of Manila, Philippines on Tuesday Dec. 1, 2015.
“It’s murder”, prosecutor Emily de los Santos said previous year, according to the Associated Press.
In addition, the judge said, there was no evidence of cruelty, treachery, use of superior strength and premeditated plan in the commission of the crime.
Joseph Scott Pemberton, 20, had been charged with murder, but the court convicted him of the lesser offense of homicide and sentenced him to six to 12 years in prison, a court clerk said.
Another family lawyer, Virgie Suarez, said Pemberton would serve at least six years and authorities would have the option of holding him longer, depending on his behaviour. He later went with the transgender women to a motel.
Pemberton had formerly testified in court that Ms Laude had been assaulted by him although he realised she was transgender, but said when he left the room she was still living. One woman left, leaving Pemberton with Laude.

Pemberton said that when he discovered Laude was a man, a fight ensued.
Witnesses told police that Pemberton was with Laude at a local disco before the two checked into a hotel on the night of October 11, according to documents seen by CNN.
Police have said Laude had apparently been drowned in a toilet.
For many, Laude’s death brought back memories of past incidents involving American service members.

Meanwhile, •the Philippines on Monday wrapped up a week of arguments in its case against China at the Permanent Court of Arbitration in the Hague. USA officials were not immediately available for comment.
Laude’s killing strained relations between the United States and the Philippines, where the Americans have a large military presence. For the past year, Pemberton has been confined at Camp Aguinaldo, a Philippine military base, in a modified shipping container cell guarded by US Marines.
In recent years, both countries have sought to rebuild defense ties.
President Barack Obama recently signed an agreement with the Philippines to allow US forces to pre-position disaster relief supplies and other materials in the country.
“It would be extremely unfair for Pemberton to remain in USA custody”, Laude’s sister, Marilou, told BuzzFeed News shortly before the verdict was announced.
