South Africa issues arrest warrant for Pistorius, reports ENCA TV
He was originally convicted of culpable homicide – akin to manslaughter – after a long-running trial under the glare of the world’s media. He is facing a much heftier sentence as murder carries a minimum of 15 years in jail.
She must now re-sentence Pistorius, who is currently out on parole after serving less than a year of his original five-year sentence.
Eyewitness News understands prosecutor Gerrie Nel and defence advocate Barry Roux have been in talks to agree on a date for Pistorius to apply for bail.
Mr. Mosetihe said some sections of the public felt that “the first judgment was not justified” and that Oscar was initially supposed to have been convicted for murder.
During the hearing, Justice Leach said that Pistorius must have forseen that his actions might kill the person behind his toilet door considering the type and number of bullets he used. Thursday, Leach ruled Pistorius should have foreseen that whoever it was behind his bathroom door would be killed upon his firing a gun though the locked toilet door.
Under the manslaughter conviction, Pistorius was sentenced to five years in jail.
He had been earlier released from prison into a luxurious house arrest arrangement of correctional supervision at his Uncle Arnold’s home in Pretoria. Masipa, who presided over the trial, must now study the Supreme Court’s ruling and hand down a new sentence, Witz said.
“I think it really comes to an end now”, said Witz.
“We are facilitating a process where Mr Pistorius appears in court as matter of extreme urgency – so that the matter can be postponed formally in court for sentencing procedures”. The Pistorius family has said attorneys will provide advice on legal options.
Prosecutors said he killed her after an argument.
