Bollywood star Salman Khan acquitted in hit-and-run case
As we all know after a wait of 13 years, Salman Khan’s 2002 hit and run case verdict has come into the actor’s favour today, but little did anyone know that the real reason behind him not marrying anyone was his 2002 case.
Bollywood superstar Salman Khan was charged in a 2002 hit-and-run case.
The high court said that the prosecution had failed to establish beyond doubt that the actor was driving and was drunk at the time of the accident.
Justice A R Joshi said this while dictating the verdict in the appeal filed by the actor against the five-year sentence awarded to him by a Mumbai sessions court on May 6 this year.
“Even warrant was not issue to him (Kamal Khan) to bring him back to India. and this is what have benefitted Salman Khan”.
In December, the court ordered a fresh trial against the actor and all witnesses who had deposed before the metropolitan magistrate court were called again to record their fresh evidence.
The court has been hearing the arguments by defence and prosecution on the appeal since October on a daily basis.
While Initially, the Lower court believed that the actor was driving under the influence of alcohol, while the High court’s judgement is a completely new twist in the story.
Khan had allegedly fled the scene after his Toyota Land Cruiser rammed into a group of people sleeping on a pavement outside a bakery in suburban Bandra in 2002.
He described Khan’s former bodyguard, Ravindra Patil, who had insisted the actor was behind the wheel and speeding, as “not wholly reliable”, citing “various anomalies in his testimony”.
The court also observed that appreciation of evidence by trial court is not proper according to principles of jurisprudence.
Consequently it st be said that this is not a case where the prosecution has successfully established its charges he observed adding that the entire evidence of the prosecution was circumstantial in nature. “Bearing this in mind, it is the considered view of this court that prosecution has failed to establish its case on all charges”, said Justice AR Joshi, reported by IBNLive.com. As far as the deposition of Ashok Singh, the family driver of Salim Khan, is concerned, it was as per rules and laid down procedures of criminal law, the court said.
