Supreme Court Orders Fresh Testing of Maggi Samples at Mysore Lab
Nestle then moved the Supreme Court and the apex court had on Tuesday sought the centre’s response to a plea of Nestle India Ltd against the NRDC order order for testing of 16 more samples of Maggi noodles in connection with the government’s Rs640 crore suit against the company for alleged unfair trade practices. “In the meantime, the NCDRC shall not proceed”, a bench of justices Dipak Misra and Prafulla C Pant said.
“100% of the samples tested show Maggi Noodles is safe for consumption and indicate lead to be much below the limit stipulated by the regulatory authorities”.
In the fresh petition by Nestle, the company has challenged the order passed by the NCDRC. This was also validated by the reports from 3 accredited laboratories mandated by the Hon’ble Bombay High Court to test the samples.
The apex court fixed the hearing plea on 13 January.
The bench, meanwhile, stayed the proceedings before the NCDRC and directed that the test report, including the earlier one, be placed before it.
During the case, Nestle India Ltd, via senior advocate Harish Salve, opposed National Consumer Disputes Redressal Commission’s direction for examination at Chennai stating it is not commissioned for salt and lead check.
However, when he sought the interim stay of the NCDRC order, the court said that the matter would to be taken up on Wednesday as it sought the central government’s response on Nestle’s plea.
However, later Nestle India and the Centre agreed for testing samples at Mysore.
The plea is towards the Bombay high court docket verdict lifting ban on 9 versions of Maggi noodles and asking the agency to go for fresh exams.
