Supreme Court dismisses DCW plea against Nirbhaya Juvenile convict release
Six persons, including the juvenile, had assaulted and raped Nirbhaya in a moving bus in south Delhi on December 16, 2012.
Disappointed with Supreme Court’s decision to reject the petition filed by the Delhi Commission for Women (DCW) against the release of the juvenile offender in the December 16 gang-rape case, Nirbhaya’s parents on Monday said that the women of this country will never get justice.
The youngest of the convicts was sent to a juvenile correctional facility for a three-year term – the maximum allowed under Indian law. He was released on December 20.
Maliwal also said that she has moved a Special Leave Petition (SLP) in the Supreme Court challenging the release of juvenile convict in the case.
“It is a black day for women in history of the country”.
In its post midnight order, the Supreme Court had declined to stop the release of the juvenile offender and posted the matter before a vacation bench to be heard today.
Sunil Madhok, a lawyer for the petitioners, said that “the court is constrained because there is no clear legislative sanction”. “According to this provision, the juvenile convict in the Nirbhaya incident would be tried as an adult”, said the Leader of Opposition, adding that the bill has not passed in the Rajya Sabha due to disruptions by the members of the Congress.
“The courts are actually concerned about the convicts and not the victims”. Women have been cheated and they continue to be cheated.
“We share your concern but under existing law, detention can not go beyond 3 years”, the Supreme Court told DCW.

There were massive protests against the release of the convict on Sunday afternoon at Rajpath. There are four more convicts.
Expressing unhappiness with the government for showing “helplessness” on the issue of the juvenile’s release, the victim’s father said, “Our government, whether Centre or state, only listens to you when you protest and get lathi-charged, else they don’t care”.
