Walmart Driver Indicted for Tracy Morgan Crash
On Wednesday, a New Jersey grand jury indicted Kevin for his involvement in the accident that killed comedian James McNair and injured the 30 Rock alum. Morgan, 47, suffered a serious brain injury and broken bones, and he was in a coma for two weeks.
Roper was operating the Walmart truck that struck a limosine carrying Morgan and several others from a show in June 2014.
Those charges carry steep sentences if Roper were found guilty: Ten to 30 years for manslaughter, 5 to 10 years for vehicular homicide and 18 months a pop for each assault charge.
Roper’s attorney, David Glassman, headed to court on Tuesday to ask a judge to dismiss one criminal count of death by auto and four counts of assault by auto, insisting his client would never be able to get a fair trial due to the negative publicity surrounding the accident, especially as Wal-Mart bosses settled a negligence lawsuit with Morgan earlier this year.
Roper was driving a Wal-Mart truck when the truck he was driving crashed into the back of the limo on the New Jersey Turnpike. An arraignment will be scheduled at a later date, according to the prosecutor’s office.
Federal investigators said Roper hadn’t slept for 28 hours before the crash.
Morgan returned to the public spotlight this fall, hostingSaturday Night Live and saluting Eddie Murphy at the Kennedy Center.
Morgan and other passengers in the limo were not wearing their seat belts when the crash occurred, which, the NHSB contributed to the severity of their injuires.
In an interview last week, he opened up further about the trauma of the crash and losing his friend, telling Barbara Walters that doctors told his wife at the time that they did not know if Morgan would emerge from his coma.
