Trucker in Tracy Morgan crash charged
A truck driver involved in an accident that severely injured comedian Tracy Morgan and killed one of his friends, could face up to thirty years in jail after he was charged with manslaughter.
Since he wasn’t in court for the indictment, Kevin is scheduled to be arraigned at some point in the future.
The driver in the truck-versus-cars accident that left Tracy Morgan and three friends injured and comic James “Jimmy Mac” McNair dead was indicted Wednesday on charges that could subject him, if he’s convicted, to decades in prison.
Roper was not in court on Wednesday to hear the grand jury’s decision. Morgan, 47, spent more than a year recovering from broken bones and a serious brain injury (he was in a coma for two weeks), and returned to the stage for the first time last October for Saturday Night Live’s 30 Rock reunion.
His lawyer, David Glassman, argued that Wal-Mart’s settlement of Morgan’s lawsuit generated publicity that harmed the Jonesboro, Georgia, resident’s chance for a fair trial. Glassman made a similar argument when Morgan made jokes about the crash at the 2015 Emmy Awards in September.
Aggravated manslaughter carries a 10 to 30-year prison term upon conviction, while a death-by-auto charge carries a five to 10-year prison sentence.
An investigation by the National Transportation Safety Board (NTSB) concluded in August that Roper had not slept for the previous 28 hours before the crash occurred.
In a June interview with TODAY’s Matt Lauer, a tearful Morgan opened up about the future of his career.
The report concluded Roper failed to slow down immediately before the crash, despite posted warning signs on the turnpike.
Federal investigators found that the injuries to Morgan and other passengers were exacerbated by their failure to wear seat belts.
