Dabangg actor Salman Khan on the occasion of his 50 birthday, launched an online shopping portal named, khanmarketonline.com. “It is likely to be dismissed as a frivolous litigation if and when the case is filed”, Sanjay Upadhyay, a Supreme Court advocate, said.
Salman Khan to be sued by Khan Market traders over new website – Delhi’s Khan Market Traders Association is likely to take legal action against Bollywood superstar Salman Khan – for launching a website whose name is similar to Khan Market.
However, if Khan Market Traders Association go to legal recourse the entire trade of Delhi will support KMTA. For all that we know, Salman Khan had tweeted on his birthday, “Thank u for ur bday wishes”. He can be a part of Khan Market first if he wants to use this name.
Established in 1951, 65-year-old Khan Market in south Delhi attracts lots of shoppers not only from Delhi, but also foreign tourists. “This portal is misusing our market’s name and hence amounts to trademark infringement”, said Sanjiv Mehra, president of Khan Market Traders’ Association. “Aur yeh raha aapka return present – http://www.KhanMarketOnline.com” The site is yet to start operations but is open for enrollments.
“If his portal announces discount on a product, people will approach us thinking that the discount is being offered by us”.
Bangalore-based legal researcher and founder of Alternative Law Forum, Lawrence Liang also added, “There’s a common legal remedy to protect unregistered trademarks”.
Social jurist advocate Ashok Agarwal dismissed it as a promotional stunt. CAIT secretary general Praveen Khandelwal said its odd how can anyone use the name of one of the prestigious market of the world for his own gains.
