‘Affluenza’ teen’s mom set for extradition hearing
At today’s hearing, Tonya Couch waived her right to fight extradition, meaning she will not be contesting Tarrant County’s request that she be transported to Fort Worth, Texas.
Tonya Couch, 48, was told by a judge in Los Angeles Superior Court that she will be held in the custody of the Los Angeles County Sheriff’s Department and that the state of Texas has two weeks to collect her.
She will now be sent back to Texas to face charges of aiding her fugitive son.
Couch and her son, Ethan, fled to Puerto Vallarta after he missed a meeting with his probation officer last month.
It’s unclear when she will be sent to Texas, where she’s charged with hindering the apprehension of a felon.
Couch, 18, was on probation for killing four people in a 2013 drunk driving crash when he was 16.
Her attorneys say in a statement that Couch looks forward to returning to Texas as soon as possible to have her day in court. He pleaded guilty to four counts of intoxication manslaughter and two counts of intoxication assault causing serious bodily injury and was sentenced to 10 years’ probation.
The 38-year-old Couch was deported from Mexico and was flown to Los Angeles early Thursday morning. His lawyer in Mexico, Fernando Benitez, said he met with the teen at the center Tuesday but declined to say what they discussed. Sam Jordan, a spokeswoman for the Tarrant County District Attorney’s Office, said in an email to The Post that officials were still waiting to hear specific details, but “generally expect” that she would be in Texas this week.
“You understand you are giving up your right to resist extradition to the State of Texas” the Judge asked Couch.
According to club employees, the pair had drinks before Tonya Couch left the club. “There was no way she was going to be released”, Anderson said.
His lawyers coined the term “affluenza” in their defense – or in other words that he was a rich kid who was less to blame for his crime because his parents didn’t set limits for him.
The diagnosis is not recognized by the American Psychiatric Association and was widely ridiculed.
Texas prosecutors believe the mother and son fled the state after a video surfaced that appears to show Ethan at a party where people were drinking.
