Pelosi leaves door open on question over Cruz’s eligibility
Under assault from Donald Trump, Ted Cruz offered something of a thinly veiled contrast Friday with his Iowa rival that he’s a bit more down to earth than the billionaire businessman. It was speculation that Obama was born outside the country, even though his mother was American, that fueled the so-called birther movement.

Trump said Cruz should to ask a judge for a “declaratory judgment” that Trump said would protect Cruz against any future questions about his eligibility that could come in a general election.
In first-to-vote Iowa, however, Cruz has taken a narrow lead over the bombastic billionaire and is favored to win. And he’s got some nerve, that guy, creeping up in the polls and starting to look as if he might just steal that nomination away from practically-president-already Trump.
Cruz was born in Alberta, Canada to an American mother and Cuban father.
The first source of interpretation involves the use of the phrase “natural-born” in British common law, which recognized that children born to subjects outside the empire were themselves “natural-born” subjects. If the court ruled that it excluded being born outside the U.S., Cruz would be forced to drop out of the race and add another blow to the GOP in 2016.
If Cruz took his case to federal court, there’s not a clear definition in the U.S. Constitution that defines the term natural born citizen. There is no ambiguity, no legal question. “I would note that it has occurred many times in history”.
In 2008, the Senate passed a resolution that John McCain was allowed to run for president even though he was born in the Panama Canal Zone, which was technically not part of the United States, because his parents were Americans.
“I think there is a question [on Cruz’s citizenship]”, McCain said in an interview with CBS’ Phoenix affiliate, KFYI.
Cruz and Obama are both constitutional law experts, but the issue of whether a person born in a foreign country to a U.S citizen is a natural born citizen has never been decided by the ultimate authority, the Supreme Court. He also distinguished the circumstances of his birth, arguing that the Canal zone was a USA territory at the time, The Post reported.

Amid all this, you can perhaps pardon the Obama White House for taking no small amount of glee at the controversy consuming the upper echelons of the Republican presidential aspirants.
