Supreme Court To Review Obama’s Immigration Policy
The case challenges President Obama’s expanded Deferred Action for Childhood Arrivals and Deferred Action for Parents of Americans and Lawful Permanent Residents programs which were announced more than a year ago.
Gilman said she believes the Supreme Court will give the case a thorough discussion but that political considerations within the court could weigh heavily in the decision. “We are confident that the policies will be upheld as lawful”, White House assistant press secretary Brandi Hoffine told reporters, according to the Washington Post. “No matter how they got here, no matter how frustrated we are with our government, we can not lose sight of their humanity – without losing our own”.
“There’s no negative action that could happen, simply the lack of positive action”, says Tim Winn, Director of Immigration Legal Services at Catholic Charities Indianapolis.
Texas Attorney General Ken Paxton said in a statement that he welcomed the review by the court: “In deciding to hear this case, the Supreme Court recognizes the importance of the separation of powers”.
More than 200 civil rights, immigration, and social rights organizations filed an amicus brief urging the Supreme Court to grant a hearing to the case, including the National Council of Asian and Pacific Americans (NCAPA), which would affect almost half a million Asian Americans.
While supporters of DAPA say it will allow Wisconsin immigrants to come out of the shadows and work legally to support their families, Dave Gorak of the Midwest Coalition to Reduce Immigration says there are already too many US citizens without work. They were put on hold November 9 by the 5th U.S. Circuit Court of Appeals in New Orleans, which upheld a Texas-based federal judge’s injunction against Obama’s actions. “But given the partisan divide in the Supreme Court, you can’t be sure of the outcome”.

On Tuesday, advocates applauded the Supreme Court’s decision to hear the case and finally settle the immigrants’ fates.
The high court added a separate question on whether the president’s action violated a provision of the U.S. Constitution that requires the president to “take care that the laws be faithfully executed”.
With some of his major legislative initiatives suffocated by Republican lawmakers, the Democratic president has resorted to executive action to get around Congress on issues including immigration, gun control and the Obamacare law.
The future of immigration has been hanging in the balance since the state of Texas challenged Obama’s executive actions following the 2014 midterm elections.
The border state of Texas is leading 26 states in challenging the immigration plan.
Wilson said this will be a step in the right direction, especially for Dreamers who were brought to the US illegally as children.
The case is scheduled for April, and a decision should be made at the end of June.
