Cabinet recommends revocation of Prez rule in Arunachal
Rebel Congress MLAs had joined hands with the Opposition BJP to reduce the Congress government of Nabam Tuki to a minority there.
The court on Tuesday refused to restrain Arunchal Pradesh governor JP Rajkhowa from taking steps for formation of a new government in the state which is now under President’s rule.
Nabam Tuki is the only CLP leader as desired by the AICC and the rank and file of the party, following the disqualification of 16 MLAs by Speaker Nabam Rebia, claimed the APYC.
“In the meantime, the parties before this court shall maintain status quo”.
Nariman said he had information that the Governor has made a recomendation about revoking President’s Rule in the state and the press note substantiated it.
The Governor had dismissed the Chief Minister and his council of ministers on January 26, even when the assembly was in suspended animation.
He said the high court had, by an interim order, stayed their disqualification and the same order is in challenge before the apex court, and argued till the court decides on their fate, they could not be counted for the objective of forming the new government. Now, the party’s only hope is that if the decision on the disqualified 14 MLAs comes in its favour, it can still claim to form the government.
The bench then sought Attorney General’s view asking what the Parliament would do, if it passes some interim orders on the plea of Arunachal Congress leaders. Eleven BJP MLAs and two independents backed the rebels in the bid to upstage the government.
“Whatever is the verdict of the court, the only answer will be floor test and the ultimate answer will be the floor test. Whether “A” becomes the Chief Minister or “B” becomes Chief Minister, it will be decided on the floor of the House”, he said.
He said the hearing was deferred on December 14 to 15, 2015 after the Speaker was informed that notices have been not served. “For further consideration”, said the court as it directed the listing of the matter on Thursday.
