Cosby sues sex-assault accuser, lawyer for contract breach

Cosby faces up to 10 years in prison if convicted of sexually assaulting Constand at his suburban Philadelphia home in 2004.
Nothing about the deal was included in the criminal complaint that detailed the exchanges between Cosby and Constand in 2005 after the victim told her mother about what happened to her. So is Constand’s mother, Gianna Constand, and the publisher of The National Enquirer. In that call, which might have been recorded, Cosby allegedly detailed what he did to Cosntand.
“Far from using their ‘best efforts” to ensure compliance with the confidentiality provisions, plaintiff and her counsel appear to have made no effort whatsoever. The defendants were all held to confidentiality clauses. O’Connor wrote, according to BuzzFeed.
The information came to light after Dolores Troiani and Bebe Kivitz, the attorneys, filed a breach-of-contract lawsuit in federal court, Yahoo News reports. A version of the complaint with redactions was made available to the public on Wednesday.
Cosby, in the deposition, said he had a contract with the Enquirer.
Cosby, who played Dr. Cliff Huxtable on “The Cosby Show” from 1984 to 1992 and has been married for decades, has denied the women’s accusations.
The criminal case was reopened by prosecutors a decade later and he was arrested just before a 12-year statute of limitations expired.
Dozens of women have accused Cosby of plying them with drugs and alcohol in a series of alleged sexual assaults dating back to the 1960s.
“Defendants are blatantly violating their confidentiality obligations under the 2006 Confidential Settlement Agreement, including by intentionally disclosing information they promised to keep confidential as consideration for the settlement”, states the lawsuit.
Cosby’s legal team did not respond to a request for comment about his new lawsuit. A judge will decide whether to dismiss a sexual assault case against the comedian over an unwritten promise of immunity that a former prosecutor says he gave Cosby’s now-deceased lawyer.
The next hearing in Cosby’s criminal case is set for March 8, when his lawyers are expected to argue, among other issues, that the Constand deposition should be thrown out.
Troiani declined to comment Thursday on behalf of herself or Constand.
