Two University of Cincinnati police officers who were interviewed about the death of an unarmed black motorist at the hands of a fellow officer will not face charges, a prosecutor said on Friday.
On Thursday, Tensing pled not guilty to murdering DuBose and his lawyer said the charges were unwarranted.
Tensing surrendered to authorities shortly after news of the indictment broke, and he is expected to be arraigned on Thursday.
Video from the body cameras of Lindenschmidt and Kidd, and a written police report illustrated the confusion and tensions in the seconds after DuBose was shot.
Brinson’s family filed a a civil suit against UC police (and the hospital), accusing the officers involved in the incident of excessive force and of acting with “deliberate indifference to the serious medical and security needs of Mr. Brinson”.
The bodycam video shows Tensing approach the vehicle and ask DuBose for his license and registration.
“Yeah, I saw that”, Kidd replied.
“He didn’t reach for anything”, Tensing replied.
“I’m not prepared to do anything like that, but there are a lot of people who are prepared to help”, Mathews told ABC News. “He couldn’t produce a license”.
She said the video evidence from Tensing proved her brother was a peaceful man.
Records from the Greenhills Police Department show that Tensing used a stun gun while working there in January 2012.
“It was unclear how much of this incident OIT Lindenschmidt witnessed”, the report noted. “People here are talking about it. I can tell you that”. Deters discussed with a conference, “It is to be reminded that Dubose was not one of the persons who were required to be murdered”. Cincinnati was convulsed with riots in 2001 after police shot an unarmed 19-year-old black man who was wanted for traffic violations. Tensing said he feared for his life that he might be run over by DuBose. When Tensing asked him to remove the seat belt, Dubose tried to prevent Tensing from opening the auto door.
“Not that we think it could happen today or tomorrow, but just our preparedness for an active shooter event”, said Drew. That’s when the footage ends.
The family of Sam DuBose, 43, has said he would have been dismissed as just “one other stereotype” of a violent black man were it not for a body camera video which showed DuBose did nothing to justify the shooting. Prosecutors also announced that two other officers suspended from the department in connection with the shooting would not be criminally charged.
The Inquirer also reported that Kidd could be charged for giving a false statement.
Tensing had been a police officer for four years before he was fired by the University of Cincinnati. “There seems to be the elements of a crime there”. Fraternal Order of Police-Ohio Labor Council representative Thomas Fehr says Tensing was let go without due process, and says that is a violation of his contract.
