Mattis, who retired from the military four years ago, needs a waiver from a law that requires defense secretaries to be out of military uniform for seven years. “He’ll get that waiver, right?”

Only a few Democrats have signaled they’ll oppose Mattis’ nomination, and most of the critics on Tuesday made clear their concerns lie with the military-civilian responsibility issues, not Mattis’ credentials.
The bill would limit debate on the one-time waiver for Mattis to 10 hours, essentially curtailing in-depth discussion about how his appointment would affect the tradition of civilian control of the military. Gen. George C. Marshall was the only officer to ever receive a waiver and he served as defense secretary in the early 1950s. The year-end funding bill must pass by Friday to avoid a government shutdown and Democratic leaders are urging the GOP to refrain from adding any wording to the bill that could set up Mattis’s position before Trump is sworn in.
Democrats including Sen. Kirsten Gillibrand, a Democrat from NY, have said they will oppose granting Mattis a waiver.
Mattis is considered a supporter of alliances with foreign countries, a departure from Trump who has accused allies of relying on the United States for their defense without paying enough.
