Supreme Court Backs Trump On Muslim Travel Ban
Sen. Ted Cruz (R-Texas) appeared on “Fox & Friends” on Thursday to react to the impending retirement of Supreme Court Justice Anthony Kennedy.
In supporting its ruling, the Supreme Court cited two historical examples.
His departure sets the stage for President Trump to nominate a second Supreme Court justice after successfully nominating Justice Neil Gorsuch to the bench a year ago. He has written all the court’s major gay-rights decisions, including the 2015 ruling that declared same-sex marriage is a constitutional right nationwide.
Among Trump’s counselors is Leonard Leo, who is taking a leave of absence as executive vice president of the Federalist Society to serve as an outside adviser to the process. If the travel ban’s objective is to ensure the security of the United States, then, by all means, keep the bad guys out.
Kennedy informed the White House in a letter that he is stepping down after 30 years of service, leaving an opening for the Trump administration to select a second high-court pick. The pressure on them – from both sides – will be enormous.
The court held that the challengers had failed to show that the ban violates either US immigration law or the US Constitution’s First Amendment prohibition on the government favouring one religion over another.
Mr Trump is likely to choose a more conservative candidate to replace Mr Kennedy, which could shift the highest court in the land to the right for decades to come. This is an important moment as we look to the future of the court.
In January 2017, the order sparked protests outside airport terminals across the United States, and was quickly subject to legal challenges.
Contentious confirmation hearings in the Senate delayed his confirmation until 2006.
“I don’t think this issue has been presented to many of them”, he said.
But while the Kennedy seat might be lost to Democrats, there’s a very different angle that Democrats can take – and already are – to prevent a further conservative tilt of the Supreme Court under Trump’s term: politics. Kirsten Gillibrand of NY wrote Tuesday on Twitter. Joe Manchin (D-W.V.), Joe Donnelly (D-Ind.) and Heidi Heitkamp (D-N.D.) all voted to confirm Justice Neil Gorsuch, and could break with their party again, in order to save their own re-election.
As the Senate barrels toward a vote on Trump’s pending Supreme Court nominee, Washington is watching two small groups of senators to see what they will do.
“In some ways I would be lying to say that it really crazily upends things”, said Michael Kimberly, who appeared before the justices in March to argue that one of Maryland’s congressional districts was unconstitutionally drawn to ensure a Democrat would get elected. “And so he went ahead and made a decision to do the list”, Leo said.
The confirmation machinery would gear up quickly. “No question about it”, McConnell said.
