Samuel DuBose: No Indictment For Two University Of Cincinnati Officers Who
On the night of July 19, Tensing pulled DuBose over for a missing front licence plate.
Appearing in court in a prison jumpsuit for his arraignment Thursday, Tensing pleaded not guilty to charges of murder and involuntary manslaughter.
Tensing was indicted Wednesday on murder and voluntary manslaughter charges in the July 19 death of DuBose, who was shot in the head during a traffic stop. “We’re going to need multiple officers here”, Kidd said, later telling Tensing that he saw him being dragged by the auto and asking if he was OK.
Hamilton County Prosecutor Joseph Deters said he agreed with the decision, and that the officers were cooperative and consistent in their statements. Their official statements about what happened matched what was shown on Tensing’s body camera, and neither officer said in official interviews that he saw Tensing being dragged, according to Deters. They say it would limit investigations into road rage, retail theft and drunken driving.
But Emmanuel Gray, an organizer with the activist group Black Lives Matter, said at a rally Wednesday evening that the body camera video made the difference in how the case was handled.
“Ever since the bond was set, I’ve received calls from around the country from people wanting to contribute to it”, Mathews said. While neither Kidd nor Weibel deployed the Taser, they were involved in restraining Brinson, and were therefore two of the seven police officers named in the suit. The incident was the latest in a string of deaths of black men at the hands of police in the past year, including Michael Brown in Ferguson, Missouri, Eric Garner in New York City, Freddie Gray in Baltimore and Walter Scott in North Charleston, South Carolina. The video bounces as Tensing chases after the vehicle as it rolls down the street. Deters stressed that the evidence showed Dubose had not acted aggressively toward Tensing, as the officer had claimed.
One account: Tensing was in a life-threatening situation, being dragged alongside DuBose’s moving auto, firing his weapon in self-defense.
Deters’ office yesterday released videos from body cameras worn by two university police officers who witnessed the shooting. “If it were not for that video camera, Sam would be no different than all of the other [unindicted police shootings of black men], because the second officer was ready to corroborate every lie that the first officer said in the report”, Terina Allen, Dubose’s sister, said at an emotional press conference.
The DuBose family lawyer, Mark O’Mara, said there should not have been any bond set. Supporters say eliminating a license plate would save money and reduce minor traffic stops, which research shows can be used in racial profiling.
Meanwhile, Tensing is trying to get his job back.
A reporter asked Deters whether he thought Tensing tried to mislead investigators looking into the incident. More than 550 people have been shot and killed by officers this year, according to a Washington Post database, and Tensing is the fourth officer to face charges.
