Bennet Officially Announces Opposition To Brett Kavanaugh Nomination
The United States Supreme Court is, by design, a profoundly antidemocratic institution, and as Republicans get ready to ram Brett Kavanaugh’s nomination through the Senate, it’s worth pointing out that it doesn’t have to be this way.

Both Moreland and Garnett stressed Kavanaugh’s record as pointing to a desire to limit Congress’ ability to support administrative agencies like the Environmental Protection Agency, the Food and Drug Administration, the Federal Trade Commission and the Federal Communications Commission to function independently of the executive branch.

The accusations will nearly certainly remain a fixture in the debate over Kavanaugh’s nomination as it continues on the confirmation process this month, but there is little sign they will change any votes in the Senate.
The Weekly Standard noted that even the author of the New York Times scoop, Charlie Savage, acknowledged Kavanaugh’s email “stops short of saying whether he personally believed that the abortion rights precedent should be considered a settled legal issue”.
In addition to generating an even more unhinged spectacle of hysteria during the confirmation process, another originalist judge on the bench would allow some of the Supreme Court’s most egregious decisions – like Roe v. Wade, which legalized abortion nationwide – to finally be dealt with. Trump appointed Associate Justice Neil Gorsuch previous year.
His nomination would then get a vote on the Senate floor during the week of September 24. Kavanaugh answered, “I’m not – I’m not – I’m not thinking of any right now, senator”.

Kavanaugh signalled respect for the landmark 1973 Roe v. Wade Supreme Court ruling legalizing abortion nationwide, calling it an important legal precedent that had been reaffirmed by the justices over the decades. They don’t all agree.
Sens. Joe Donnelly in IN or Claire McCaskill in Missouri may benefit from a court battle that energizes the Democratic base.
He said the Republicans had changed the rules so that a simple majority of 51 senators is sufficient to confirm Kavanaugh’s appointment, instead of the 66 votes previously required.
