Samsung is not backing down, will face Apple in the Supreme Court
Samsung has received a setback in the patent case the company filed against Apple.
On the other hand, reporters had a failed attempt to reach any Apple officials and could not come up with any comments on the decision. If Samsung’s request had been granted, a new hearing would have been held to determine whether the company’s products actually violated Apple’s patents.
The long-running patent litigation between rivals Apple and Samsung goes back to a California trial court to decide how much the South Korean tech giant should pay its Cupertino-based competitor.
In light of the ruling, however, Samsung now has two options; it can give up its hard-earned cash and admit to Apple that their patents were violated, or it can continue to fight the allegations at the Supreme Court. Apple Pay already controls a significant percentage of the mobile payment marketplace, and there is no doubt that Samsung has its work cut out to close this initial gap.
The companies collectively stated: “If allowed to stand, that decision will lead to absurd results and have a devastating impact on companies…who spend billions of dollars annually on research and development for complex technologies and their components”.
The products involved in this particular case, such as the iPhone 4, are now near-relics in the tech market, flooded these days with Apple’s iPhone 6 and Samsung’s Galaxy S5.
“It’s no coincidence that Samsung’s latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging”, says an Apple representative back in 2011. Judge Koh denied the request, saying that “Apple has not demonstrated that it will suffer irreparable harm to its reputation or goodwill as an innovator without an injunction”. Samsung had $370 million of the original award thrown out as the court ruled that Apple could not collect on issues pertaining to “trade dress”, including the basic shape of a smartphone.
Or take it up with U.S Supreme Court and try and find a way to convince it to hear its case.
