Judge Berman allows Tom Brady to miss Wednesday’s meeting, attend practice
Originally brought to the court by the league after it upheld the four-game suspension of New England Patriots quarterback Tom Brady, Judge Berman is also hearing a counter-suit by the union attempting to strike down the league’s decision.
There are no additional talks with the judge scheduled before a hearing next week, though lawyers are expected to continue negotiations on their own.
Rosenberg’s drawing of Brady went viral amid a court hearing Wednesday over whether he will have to serve a four-game suspension after he was accused of orchestrating the deflation of game balls in January’s AFC Championship game, aka “Deflategate”.
“He hardly looked up at all”, she said, adding with a bit more sarcasm that the athlete does not seem to be interested in what is happening around him.
Ted Wells, an attorney and NFL-sponsored investigator to investigate how the footballs were deflated below league standards, placed the blame on two Pats employees but said that Tom Brady was “at least generally aware” of the scheme. Berman also pointed out that the balls in question didn’t appear to give Brady any competitive advantage, given that he played better with the untouched balls in the later half of the game.
On Wednesday, Chase wrote a piece for USA Today with the headline, “Tom Brady has ruined what was left of his Golden Boy image”.
After about 80 minutes of the hearing being open to the public, Berman met with both sides individually in his quarters.
The lawsuit came about after Goodell rejected Brady’s appeal against his match ban on July 28.
However, Berman did have some concerns about the way that Brady handled the investigation into his actions-particularly the fact that he destroyed his phone.
But if the questioning from US District Court judge Richard Berman is an indication of how he is leaning, the NFL’s suspension of Brady in the Deflategate case may be in trouble.
Nash told the judge other evidence “clearly indicates Mr. Brady’s knowledge and encouragement of this activity”. At one point the judge said according to Brown: “From a legal perspective you have to be able to show that conspirators intended to be in a conspiracy … is there a meeting?”
Neither Brady nor Goodell attended Thursday’s talks. An NFL lawyer did not immediately respond to a request for comment.
Goodell was greeted Wednesday by a smattering of boos as he walked in.
Dozens of fans and journalists waited for two of the NFL’s most famous faces at the front entrance of the courthouse, including some wearing deflated football hats they were hoping to sell.
Both sides have asked Berman to decide on the case before September 4, a week before the Patriots’ season-opener against the Pittsburgh Steelers.
