Kelly Rutherford Reveals Why She Refused to Return Kids to Daniel Giersch
Giersch and Rutherford married in 2007, then in 2009.
Giersch’s rep told TMZ: ‘There was no scene. And his mother was sitting there with plane tickets, smiling, ready to take them.

Speaking about the hearing, which was held after the 46-year-old actress refused to fly her children back to Monaco as previously agreed, and Daniel, whose U.S. visa was revoked a few years ago, accused her of child abduction, she said: “He was in communication with them every day”.
“I told my son, ‘Mommy is still fighting for you, ‘” she told ABC News.
Rutherford said her children’s reactions made her scared, too.
This was after Rutherford was served a habeas corpus filed on Monday by her ex-husband Daniel Giersch to address the issue that she had not sent their children back to their father in Monaco last week. “I just needed a moment to figure out what to do”.

Rutherford’s attorney notes that it states, “when a parent makes an agreement never to establish a child’s residency in a foreign country, especially one where the child has no citizenship, no country can lawfully claim the child as its own resident”. Following a hearing August 11, Judge Ellen Gesmer ordered Rutherford to hand the children over to Giersch’s mother, who immediately flew back to Monaco to reunite them with their father. Giersch considered this kidnapping since she did not return them after her five weeks were up. Rutherford claimed that her kids always ask her if she’s doing everything to get them back, and she reportedly assured them that she is. It’s scary. My kids have been through a lot. “I’ve done everything I possibly can to let them think that everything is normal”.
‘This whole time, what I’ve had to do is take an overall situation that’s so weird and try to keep my kids healthy. “I didn’t know what to do”. I don’t want them to be fearful.
Rutherford stated, “I did my best to comfort the children, but there are no words to help children understand why a judge would be so cruel”.
She said: “The federal court’s decision was obviously incorrect, and we are appealing”.
“What the judge did yesterday was shocking, illegal and abusive to my children”, she stated to PEOPLE. “How on earth could a judge from the lowest ranking court in the State court system find it proper to grant American citizens less legal protections, in terms of the right to LIVE in the United States, than people who are not citizens and have no right to be here?”
