Actress Kelly Rutherford in court for custody battle

The former Gossip Girl actress has been in a bitter battle with ex-husband Daniel Giersch over the custody of their children eight-year-old Hermés and six-year-old Helena for months. They sent the actress a letter in which they demanded that Rutherford send the children back to Monaco immediately, followed by their petitioning New York County Supreme Court to intervene.

Tuesday, a Manhattan judge ordered actress Kelly Rutherford to return her son and daughter to their father overseas.

Rutherford was ordered to return her children to Monaco last Thursday, but refused.

The order was mandated in Monaco, where the two children having been staying with their dad since 2012 after Giersh was granted temporary custody over the young minors.

Rutherford also says her ex lied so he could get an emergency order. Rutherford argued that she was willing to have a mutually agreed party hold them but did not want to turn the documents over to a designee of Giersch’s choice.

Kelly Rutherford has already reached out to the U.S State of Department and has asked for help regarding her situation. “Given Kelly’s initial failure to send the children back, showing up without them was probably the nail in her coffin”.

“Kelly’s failure to deliver the children on Thursday likely bought them a one-way ticket to Monaco”, Michael Stutman, the head of the family group at Mishcon de Reya New York, said. “The children’s father didn’t care enough about his children to be here himself”.

“We are pleased that the American judicial system has prevailed”, Giersch’s attorney Fahi Takesh Hallin told ABC News in a statement.
