After investigation, police say no charges in case of alleged
LPD Chief Peschong announced that the investigation is complete and no arrests have been made.
Kelly said in a press conference Wednesday morning that filing charges “would require proof beyond a reasonable doubt that a crime had occurred”.
Armstrong, Westerkamp and their other roommate, tight end Trey Foster, had friends at their house on November 15 after returning from a road game against Rutgers in New Jersey. Six people were in the home at the time of the alleged incident and Chief Peschong says all were questioned. The woman told police she knows the suspect, and officers contacted that person.
Armstrong told the Omaha World-Herald last week that he was told the sex was “consensual”.
“Forensic evidence wasn’t an issue, otherwise we might not be talking to you today”, Kelly said.
The university was also investigating Armstrong, Westerkamp and Foster.
All are juniors and all have been practicing for the regular season finale Friday with 3rd-ranked Iowa during the investigation. In a written statement the University of Nebraska Athletics Department, said that athletic officials were aware of the announcement by law enforcement and that there was “no change in the status of any student-athletes”.
