Allahabad HC removes UPPSC chief Anil Yadav
While setting aside the appointment of Yadav as the UPPSC Chairman, a division bench of the court comprising Chief Justice D Y Chandrachud and Justice Yashwant Verma held that the same was “arbitrary”, “illegal”, “ultra vires of Article 316 of the Constitution” and effected “without application of mind, ignoring suitability and availability of other candidates”.
The Akhilesh Yadav government in Uttar Pradesh received a major setback on Wednesday when the Allahabad high court ordered the removal of Mr Anil Yadav, chairman of the UP Public Service Commission.
The petitioner had also stated that initially Yadav was appointed as lecturer in an added institution and thereafter he was appointed as principal. The petitions were led by a PIL filed by Bhrashtachar Mukti Morcha.
Anil Yadav was today removed from the post of Chairman of UP Public Service Commission. After Samajwadi Party came to power, he was appointed as member of UPPSC in December 2006. The court had asked the Registrar General of this court to keep it in the safe custody.In the PIL, the plea of the petitioner’s counsel was that chairman Yadav was a man of doubtful integrity and the way, he was appointed by the state government was highly uncalled for.
The Allahabad High Court had recently struck down the appointment of Sanil Kumar as Chairman of the UP Secondary Education Services Selection Board. Anil Yadav has had a chequered past littered with several criminal cases and has even been charged under the Gangster Act. His tenure was marred by allegations of openly siding, promoting and patronising members of his community during the selection process of various posts in the state.
Yadav also courted controversy when the paper of the PCS-Pre exams of 2015 was leaked.
Earlier, after hearing all sides including the petitioner, state government and UPPSC at length, the court had concluded the hearing on Tuesday (October 13, 2015). The aspirants gathered outside the High court premises in large numbers and took out a procession celebrating the verdict. The state government had appointed Kumar to the post after his predecessor Aneeta Yadav and two other Board members were “restrained from functioning” by a court order dated July 6as they did not possess the requisite qualifications.
