Apple asks top USA court to reject Samsung appeal
The second most valuable company in the world further added that this case might be high-profile, but Samsung hasn’t given any substantial reason whatsoever to prolong it this far.
The latest in the ongoing legal battle between the giants have now revealed that Samsung is taking the patent battle right into the United States Supreme court in the form of an appeal against the case that Apple has filed against them.
“Samsung had its day in court – many days, in fact – and the properly instructed jury was well-justified in finding that Samsung copied Apple’s designs and should pay the damages that the statute expressly authorizes”, Apple said in its response, first reported by the blog Foss Patents.
The court ordered Samsung to pay a whopping $548 million to Apple after Samsung was found guilty of violating patent rules.
The decision to whether re-open the Samsung vs Apple case is still undecided, the US Supreme Court is to make a decision over the matter. However, Samsung claims that due to legal principles, it is determined to fight the verdict.
In a brief made available Thursday, Apple Inc. rejected the assertion from Samsung Electronics Co.
In its Thursday filing, Apple argued that the method of awarding damages is a settled issue and hence not worthy of a Supreme Court review.
In Apple’s opinion, the litigation is “legally unexceptional”, and the Supreme Court has no strong ground to feed it. Back in December, it was announced that Apple and Samsung had reached a 8 million settlement, but with a catch.
Samsung goes on to say that this type of precedent, which it calls “opportunistic lawsuits”, could cause grief throughout the American economy. Samsung’s Supreme Court appeal was a last ditch effort, and should the Supreme Court refuse to hear the case, Samsung will not be able to recoup its money, putting an end to a patent battle that’s been going on since 2012.
