Biafra: Court orders unconditional release of Nnamdi Kanu
The Abuja high court’s order to release Nnamdi Kanu came a day after the prosecution withdrew criminal charges against him in a magistrate court.
He said the SSS had evidence of bank accounts owned by the accused person where monies were allegedly used for financing acts of terrorism against the country, while also noting that Kanu had dual citizenship of Britain and Nigeria hence he could flee and escape justice if granted bail.
The court decision was based on the ruling that the continued detention of Kanu by the Department of States Services (DSS) was unlawful.
According to the Chief Magistrate, Shuaibu Usman, since the counsel to the State Security Services, (SSS), through its lawyer, Moses Idakwo had filed for a discontinuation of the case, he had no option than to discharge the accused.
You will recall that Usman was scheduled to deliver judgment on the application of the DSS on December 1, but he had postponed the date.
Kanu’s detention generated widespread protests in the South-east and some parts of the South-south by his supporters, who called for his unconditional release.
Ruling on the fundamental right enforcement suit Kanu lodged before the high court, Justice Ademola Adeniyi said there was no basis for the applicant to remain as no charges were pending against him.
After the lower court granted him bail, the DSS got an order of the Federal High Court, Abuja Division to keep Kanu for another ninety days.
On Wednesday, the protesters stormed Lagos, the nation’s commercial capital, demanding Kanu’s release and Biafran independence.
