Bill Cosby feels ‘under attack’ after his 1st night in prison
The judge said he recognized the defendant’s age and blindness, but said they could not be the determining factors.
Wesley Oliver, director of the criminal justice program at Duquesne University in Pittsburgh, said the defense would likely question why O’Neill changed his mind. The original idea was for Cosby to seek an immediate transfer, but upon meeting the COs and prison guards, the decision was overturned.
The comedian did not make a statement in court.
Prosecutor Stewart Ryan repeatedly said they had “created” the affidavit.
“Now, nearly 15 years later, I’m a middle-aged woman who’s been stuck in a holding pattern for most of her adult life, unable to heal fully or to move forward”.
Ahead of the second trial, however, O’Neill gave prosecutors permission to call five women as witnesses. Constand has said she regarded the relationship as “a honest friendship” that included dinners out, gifts and visits to Cosby’s houses in Philadelphia and NY.
In the future, balancing the rights of the victim with the rights of the accused will be a challenge, considering the difficulty of gathering evidence from decades-old crimes. She told police about the incident in 2005, but prosecutors declined to press charges.
Cosby’s former lawyer, Tom Mesereau, said the case it not yet over and Cosby will appeal much of the sentencing.
Cosby is also defending defamation lawsuits filed by at least 10 accusers in MA and California, which were mostly put on hold during the criminal case but should now pick up. Cosby claimed the encounter was consensual, and his lawyers branded her a “con artist” who framed the comedian to get a big payday – a $3.4 million settlement she received over a decade ago. Or that time he delivered the sermon on the mount, where he threatened dozens of women into staying silent about sexual assault? “I’m going to say he had no reputation to harm”.
At his sentencing on Monday, Cosby’s defense attorneys anxious that Cosby’s age, vision impairment and declining health could make him a target. Now behind bars, Cosby hasn’t been having the greatest time.
“At least we know where to find him”, Cammarata said. “He’ll be treated like other inmates”, Worden said.
By giving Cosby a minimum sentence within the 1- to 4-year state guidelines, O’Neill may have averted another potential appeal issue. He will now have to register as a sex offender for the rest of his life.
“I believe that I was part of a very important case and I had a team of people to help me”.
