Bob McDonnell headed to prison after appeals court rejection
Prosecutors opposed the request, arguing that McDonnell should begin serving his term now that the appeals court has finished with the case.
The court order states that McDonnell’s release, was denied, though it did not provide an explanation for why. The full court last week refused to reconsider a ruling from a three-judge panel of the same court upholding the convictions against Bob McDonnell.
The former governor was sentenced to two years in prison; his wife to a year and a day. Robert McDonnell hopes to still be allowed to stay out of jail while he speaks to the Supreme Court. They say McDonnell’s case clearly raises important legal questions that merit review by the high court.
But McDonnell can still ask the Supreme Court to let him stay free while he seeks its review. Roberts handles emergency appeals from the Fourth Circuit, and he can decide the matter himself, or refer it to the entire Supreme Court.
“I think there’s a chance, but it’s probably a longshot”, Tobias said Thursday. But first, the courts typically take several days to submit pre-sentencing reports and any other information and documentation to the bureau.
