Boy fatally beaten for eating cake without permission, cops say
Shortly after, Wilson was charged with first-degree assault and child abuse.
On Monday, both the mother and the uncle of 9-year-old Jack Garcia were taken into custody.
Police arrested Oriana Garcia, 26, and Jacob Barajas, 23, and charged them with second-degree murder over Jack Garcia’s death in Hagerstown, Maryland.
Police said Garcia’s boyfriend, Robert Wilson, 30, handcuffed and beat her son late that night after he caught him eating birthday cake without permission at their home in Hagerstown, about 50 miles northwest of Washington. Garcia died five days later.

Kifer did not say whether more serious charges would be filed against Wilson.
The announcement of the charges against Jack Garcia’s mother and uncle came a day after hundreds gathered at Hagerstown City Park for a vigil for Jack Garcia. Police said he and his family are from the West Coast.
