California man charged with hitting Uber driver sues driver
According to NBC News, Benjamin Golden is suing driver Edward Caban and saying that Caban is responsible for any injuries he suffered.
The driver sued Golden for more than $25,000 for damages but now Golden is filing a cross-compliant.
The now-viral video captured by a dashboard-mounted camera shows Golden repeatedly striking Caban on the trip.

Golden worked for Yum Brands and was a corporate manager for Taco Bell in California.
Caban said he was forced to quit his job as a driver following the attack, and now lives in fear following the confrontation.
The legal battle between the pair began after Golden got into Caban’s cab on Friday October 30, shortly after 8pm, having called him to a Mexican restaurant in Cosa Mesa, California.
But not long after the video blew up, the ousted exec went on record and admitted not being able to remember the incident, breaking down and saying, “It’s not me in the video”.
The lawsuit claims invasion of privacy, negligent infliction of emotional distress, intentional infliction of emotional distress, assault and battery.
Both Golden’s claim for $5 million in damages from Caban and others, as well as his suggestion that Caban bore responsibility for any “damages” he incurred, are contained in court documents filed in response to Caban’s own civil lawsuit against Golden for the attack.
Although those documents were filed last month, they have not previously been reported in the media. “I don’t normally do that and this is a situation where I did”, Golden admits in the interview.
He also characterizes Caban as being opportunistic for making the video public.
“I want to apologize”. The lawyer also said that he believes that the state penal code only applies to audio recording, not video recording.
“He lost his job because of the video portion of the record, which showed the violence”, he said.
Distressed, Caban said he pulled into a parking lot and asked Golden to get out.
