DraftKings, FanDuel lose in effort to block NY shutdown
DraftKings and FanDuel have both stated that they will fight the NY ban in court, though they had been hoping to allow players the right to continue until a formal ruling came from the courts.
Schneiderman’s office scoffed at the legislation.
But FanDuel and DraftKings are OK with that label in the United Kingdom.
They return to court November 25. Boies says Schneiderman withheld that information so that DraftKings couldn’t challenge his action in court before it was announced.
DraftKings, in a statement issued after the order, said the company “is confident in our legal position”.
According to Balsam, “Schneiderman really jumped the gun here”.
DraftKings, based in Boston, argues in court documents Monday that Schneiderman’s decision would severely harm its business in the rest of the country as well.
“DraftKings and FanDuel have hired a fleet of lobbyists to convince the Legislature to legalize their gambling operations”, said Schneiderman spokesman Damien LaVera.

FanDuel did not have an immediate comment as to whether it will also seek a restraining order. As for DraftKings itself, it can’t be considered a bookmaker, the filing argues, because the company is a third party that doesn’t make more or less with any action.
FanDuel stopped taking new deposits from players in NY on Friday. A source familiar with the situation has confirmed that report to CBS MoneyWatch.
Cincinnati-based Vantiv is a key player in fantasy sports, noting on its website that it can increase “operational efficiency by reducing fraud, managing chargebacks and providing customer conversion guidance”.
However, Schneiderman’s office strongly disputed that characterization.
“I’m not easily shocked, but this has been a shocking, irresponsible, irrational and illegal rush to judgment”, DraftKings lawyer Randy Mastro said in court.
“We’re saying that to have a truly level playing field, any type of gambling that wants to operate in NY has to have an exemption the same way the horse guys got it, the same way the casino people got it”, Schneiderman said.
