Emails show alleged victim later contacted Canada radio host
The former host of CBC Radio’s popular culture show “Q” has pleaded not guilty to four counts of sexual assault – two of which relate to the first witness – and one count of overcoming resistance by choking.
Ghomeshi faces three charges of sexual assault and one count of overcoming resistance by choking.
The CBC began an inquiry into Mr Ghomeshi’s sexual activities after Canada’s Toronto Star newspaper began investigating allegations by an ex-girlfriend that he had engaged in non-consensual, violent sex with her.
While the other two women’s identities are now protected by a publication ban, one of the complainants, actress Lucy Decoutere, known for her role as Lucy in Trailer Park Boys, has appeared in court to waive this right.
After the taping, and while in Ghomeshi’s auto which she described as a Volkswagen Beetle, the woman said they were kissing when he suddenly pulled her hair hard.
October 30, 2014: Ghomeshi issues a Facebook post saying that he intends to “meet these allegations directly, ” but adding he will not communicate with the media.
Neither Ghomeshi nor his lawyer spoke as they headed into court, but Ghomeshi clasped the hand of a woman inside the courtroom and said, “Hi mom”.
Ghomeshi is represented by defense lawyer Marie Henein, whose former clients include Michael Bryant, the one-time attorney general. “I’m feeling very safe…”
On Oct. 29, three days before she went to the police, the woman told the Toronto Star the assault happened as soon as she got in Ghomeshi’s auto.
The woman said she didn’t go to police at the time because she didn’t think a complaint would go anywhere.
After the alleged incident at his home, the witness said she did not see Ghomeshi again.
The details: The incidents are alleged to have taken place between December, 2002, and July, 2003, when Mr. Ghomeshi was the host of the arts show play on CBC-TV’s Newsworld channel. Many things are known but not how the judge (who will try the case alone) will assess the value of the evidence. I was focusing on the main parts, said the witness.
Crown lawyers tend to keep a low profile because “their professional ethics dictate that they do their talking in the court”, unlike defence lawyers, who have no such constraints, Moustacalis said.
He then called her a cab and she left, the witness said. “I didn’t put it out because I wasn’t sure of the memory because I needed to sit with it”. To convict Ghomeshi on the first count of sexual assault, for instance, Justice William Horkins must be satisfied beyond a reasonable doubt that Ghomeshi’s hair pulling was sexual in nature.
