Family files wrongful death suit against Tony Stewart
The lawsuit, filed on Friday in New York, includes claims that Stewart wrongfully caused Ward’s death by acting with “wanton, reckless and malicious intent and negligence”.
He exited the vehicle and walked down the track, waving his arms at Mr Stewart in an apparent attempt to confront him. An Ontario County (N.Y.) grand jury ruled September 24 that Stewart would not face criminal charges. The district attorney who also handled the case said Ward had enough marijuana in his system to influence his actions the night he was killed. “I think there are always positives that come out of every scenario”. With Allmendinger and the likes of Kasey Kahne, five-time race victor Tony Stewart, Clint Bowyer, Greg Biffle, Kyle Larson and Sam Hornish Jr. winless this season, it could lead to some interesting racing Sunday. That’s what this weekend is for the four-time champ, but it isn’t a joy ride, Gordon could use a win as he still eyes a guaranteed spot in the Sprint Cup Chase For the Championship.
Stewart qualified seventh and finished 19th in his most recent start on The Glen’s 2.45-mile/11-turn natural-terrain/short-course layout in 2012. I don’t know how anybody ever could be back to exactly the way they were.
The lawsuit contends that Stewart hit the accelerator as he drove past Ward, causing the vehicle to slide and strike the 20-year-old.
NASCAR Sprint Cup owner-driver Tony Stewart was expansive on a number of topics this week, with one noteworthy exception. Ward was struck by Stewart, who called it “100 percent an accident”.
Tony Stewart speaks publicly for the first time regarding the death of Kevin Ward. “I can’t wait for the offseason to get the plates removed in my foot and then I feel like I’ll be right back to what I was before”.
“There are no guarantees unless you get that win”, Gordon said. Thirteen drivers have a better average career finish at the Glen than Logano; you can sense who I like more.
Despite Ward’s death coming in an event not sponsored by NASCAR, the racing governing body Stewart drives and owns a team under banned drivers from walking onto the racing surface.
It’s been a hard last three seasons for Stewart, 44.
“On one side, it’s encouraging because you know that the organization is capable of doing it, and on the other side, you are frustrated because you can’t figure it out yourself”.
“We used to have full-on, specialized road course cars where they were completely dedicated to turning right more so than left”.
A win Sunday would give Kyle Busch victories on both road courses this season.
The Ward family had hinted for months that it would sue Stewart, even though he had expressed deep remorse for the accident and had offered to sit down with Ward’s family.
