Florida man arrested; doughnut flakes test positive for meth
Rushing told the outlet that he agreed to a search of his auto because he knew he had nothing to hide. In the end, however, the substance was glaze from a Krispy Kreme doughnut.
On December 11, 2015, 64-year-old Daniel Rushing was pulled over for speeding and not coming to a full stop when exiting a 7-Eleven parking lot, an arrest warrant said. Rushing was returning from dropping off a friend at the hospital for a chemotherapy appointment and pulled into a 7-Eleven that was under OPD surveillance “because of complaints about drug activity”, reports Rene Stutzman. “They tried to say it was crack cocaine at first, then they said, ‘No, it’s meth, crystal meth, ‘” Rushing told the Orlando Sentinel.
The officer spotted “a rock like substance on the floor board where his feet were”, according to a police report obtained by the Orlando Sentinel.
When Rushing opened his wallet, the officer noticed that he had a concealed weapons permit.
During an inspection of his vehicle, officer Shelby Riggs-Hopkins discovered what she identified as “some sort of narcotic”, according to a police report published by the Sun Sentinel. “I conducted a separate test on the substance and received another positive indication for amphetamines”.
When officers pointed out the believed narcotic substance on the floorboard Rushing insisted it was sugar from the Krispy Kreme doughnut.
Rushing was strip-searched and held at the county jail for 10 hours before being released on a $2,500 bond.
A crime lab with the Florida Department of Law Enforcement ran a test on the substance and determined that it was not an illegal drug, so the charges were dropped.
Three days later, the State Attorney’s Office in Orlando filed paperwork, saying it was dropping the case.
Rushing is now asking for damages from the city, saying he was arrested for no reason at all.
