Salman moved the Bombay High Court, which opines that section 304-II of IPC could not be applied to the case in June.
In the early hours of September 28, 2002, Khan’s white Toyota Land Cruiser rammed into the American Express Bakery in suburban Bandra, close to his sea-front home in Galaxy Apartments, before fleeing from the accident site. In the FIR filed soon after the mishap, he did not implicate Salman but in the statement he said that Salman was driving under the influence of liquor.
Several witnesses, including survivors of the crash, testified that Khan was driving the vehicle, but Salman claimed that his driver was behind the wheel. Many people are also said that they are happy for Salman Khan Relief Whereas many people want Justice for the Person who died in the accident. Judge Deshpande also charged Salman Khan with culpable homicide and awarded a sentence of 5 years.
Delivering the much-awaited verdict, Justice AR Joshi said that the actor “cannot be convicted” on the basis of the evidences produced by the prosecution in the 13-year-old case and trial.
The court discredited the testimony of a key prosecution witness – Mr Khan’s bodyguard Ravindra Patil – who had said that the actor was driving drunk and had ignored his repeated warnings. “This is not the case, in which the prosecution has successfully established its case on charges an resultantly the following orders to be passed”.
The high court said this was “not a case where prosecution has successfully established its case of all its charges”. If the court had to pronounce a judgement in his favour it could have done so many years back.
