Under current Texas law, background checks are not required with private person-to-person gun sales. That person must run a background check before they can release the gun to the buyer.
The president’s proposal will require gun dealers to be licensed and to conduct background checks.

In the same interview, Biden noted that the GOP candidates are telling him that they’re tired of the carnival atmosphere in their race.

After the Sandy Hook shooting, Obama in 2013, Obama sought far-reaching, bipartisan legislation that went beyond background checks to ban certain assault-style weapons and cap the size of ammunition clips.
