Judge Acquits Chicago Police Commander Accused Of Shoved Gun Down Man’s Throat
Evans, who has worked for the Chicago Police Department (CPD) for 30 years, was found not guilty of official misconduct and aggravated battery.
Prosecutors told Cook County Criminal Court Judge Diane Cannon that the commander crossed the line into criminal conduct during the arrest, and that Williams’ DNA was on Evans’ gun.
Still, in announcing her decision, Cannon pointed out inconsistencies with Williams’ testimony, noting that he was “eager” to change his testimony “at anyone’s request”.
She also dismissed evidence that Williams’ DNA was found on the gun and said Evans has enough “lawful contact” with him to explain how it got there. She also said Williams’ saliva wasn’t tested for gun residue and the inside of the barrel wasn’t tested for his DNA, suggesting the DNA could have gotten on the gun during a tussle with officers.
In an unexpected twist, Servin was found not guilty in May after Cook County Judge Dennis Porter said prosecutors should have charged the officer with a more serious offense than involuntary manslaughter. Last week, the embattled mayor ousted Scott Ando, the head of the Independent Police Review Authority (IPRA), the city agency tasked with reviewing serious allegations of police misconduct that helped spur the criminal investigation of Evans.
Williams “defied belief” when he said that Evans attacked him and another officer punched him and smashed his face into the kitchen floor in a decrepit, abandoned house at 7105 S. Eberhart Ave., Morask said.

Inside the house, Williams claimed Evans crammed a pistol into Williams’ mouth and held a Taser on his groin while demanding information on a recent shooting in the neighborhood. “This is not a case of police brutality”, Morask said.

The judge also interrupted Freeman’s argument to tell her to stop claiming that police never bring charges for gun offenses if no weapon was recovered, saying it wasn’t true and she didn’t want to give the public a false impression of the law.
A DNA expert who testified in court Wednesday said she found Williams’ DNA on Evans’ gun after the alleged incident.
“I think Mr. Ando is a very intelligent man, but he clearly did not have command or control of his organization”, said Dean Morask, an attorney for Evans.
Despite the passage of time, and with Chicago paying more than $500 million to settle cases with torture victims, the Burge legacy is still a potent one on the streets.
Asked for a response to the Coleman ruling, a spokeswoman for Emanuel, Shannon Breymaier, noted that the Independent Police Review Authority last week reopened its investigation of the incident after previously clearing the half-dozen officers who were there. Williams later changed his story when the state’s attorney’s office informed him of photos showing Evans wearing his gun holster on his right side. Garry McCarthy’s most-trusted commanders though Evans had racked up 45 excessive use-of-force complaints between 1988 and 2008, according to a WBEZ investigation. Evans’ attorneys tried to paint the agency’s probe as biased against the officer.
