Judge Orders Homeland Security Chief, Others To Court
The judge’s ultimate ultimatum, he warned none other than the top DHS leadership to show up at his courtroom next month for a previously unscheduled hearing – just so they can explain to him why he shouldn’t hold them in contempt of court.
Along with Johnson, the heads of USA Customs and Border Protection, USA Immigration and Customs Enforcement, and USA Citizenship and Immigration Services are also required to attend, according to The Daily Caller. In addition to the individual Defendants, the Government shall bring all relevant witnesses on this topic as theCourt will not continue this matter to a later date.
The executive order was blocked when 26 states claimed Obama’s actions are unconstitutional because they amount to lawmaking that should be left up to Congress. It admitted that it violated this Court’s injunction on at least 2,000 occasions-violations which have not yet been fixed.
He issued an order earlier this week saying that while he had been willing to believe the actions were accidental, he was “shocked and surprised” at the “cavalier attitude” the government had taken to rectify the situation. The Government has conceded that it has directly violated this Court’s Order in its May 7, 2015 Advisory, yet, as of today, two months have passed since the Advisory and it has not remediated its own violative behavior.
He characterized the administration’s apparent nonchalance as “unacceptable” and “completely unprofessional”. Neither side should interpret this Court’s personal preference to not sanction lawyers or parties as an indication that it will merely acquiesce to a party’s unlawful conduct.
Legal experts said the case likely will wind up before the Supreme Court and could ultimately land back in Judge Hanen’s court.
In February, a federal court judge in Brownsville, Texas, sided with the states and ordered a temporary injunction blocking Obama’s plan while the lawsuit works its way through the courts.
A DHS spokeswoman told Politico the department is aware of the judge’s latest order, but didn’t get into details.
Andrew Hanen’s about had it with President Obama’s Homeland Security Department and its program to legalize millions of undocumented youngsters and their parents.
On Friday, the Fifth Circuit Court of Appeals, in New Orleans, will hear oral arguments on whether Judge Hanen’s block should stand. The administration contends that the law grants the executive branch the prosecutorial discretion to prioritize who should be removed from the country.
