Kelly Rutherford’s ex granted custody
– More than six years later, actress Kelly Rutherford has reportedly lost her legal battle to gain full custody of her two children with her ex-husband, Daniel Giersch.
The rulings by a judge in Monaco followed a legal brawl that erupted in August, when Rutherford was forced to surrender son Hermes, 9, and daughter Helena, 6, to Giersch’s mom inside a closed New York City courtroom.
Kelly, 47, will be included in the children’s schooling and health, as the court stated that the parents must make the decisions jointly over their “health, schooling, religious education and any change of residence”.
While Giersch will be legally obligated to consult Rutherford on major decisions such as where the children will attend school, Kelly’s interactions with the kids will be limited to visits that must take place in either France or Monaco.
The children – who are U.S born citizens – were last in this country during the summer.

But the two children must live with her ex-husband Giersch. Giersch has now been granted the right to obtain German passports for his children, something to which Kelly has long objected.
She said: “Divorce is a total racket – let’s call it what it is”. A judge subsequently ordered for the kids to be sent back.
After having the children in the US, Kelly was to ordered to return her children to Monac o.
In the ugly to and fro of the legal battle Kelly’s attorney’s described Giersch as, ‘paranoid, hostile, narcissistic, rigid and cold’.
According to the Daily Mail, a judge in Monaco, where Giersch has lived with the children for the past three years, granted full custody to Giersch, 41.
Kelly has filed an appeal and declined to comment on the court decision.
