Kelly Rutherford Slams Judge Who Ordered Her Children Back to Monaco: “I”
The “Gossip Girl” actress’ children Hermes, eight, and Helena, six, had been staying with her in New York over the summer holidays and although she claims she was awarded sole custody of them earlier this year, she was today (11.08.15) forced to say goodbye to them in court before they were returned to their father, Kelly’s ex-husband Daniel Giersch.
The actress appeared in court Tuesday morning to face the consequences of failing to send her children back in Monaco on Friday, stated People.
“What the judge did yesterday was shocking, illegal, and abusive to my children”, she said. Since then, Rutherford has been fighting to keep her children on U.S. soil and raised separate appeals with the California and New York courts.
The ruling comes days after Rutherford defied a court order from the Mediterranean country of Monaco to return the children there.
Kelly Rutherford with her children on July 25, 2015. The children were eventually brought to court when the judge ruled against her. Cries of joy were audible when the grandmother and children reunited outside the tiny courtroom. “The judge did not listen to one word I said and instead demanded that the children immediately be taken from my custody, and handed over to the lawyers for delivery to an airport”. Contrary to his many false claims, he, like all German citizens, can come to this country anytime on his German passport.
Rutherford’s lengthy custody battle has been ongoing since 2012, when a California judge sent the children to live in France with Rutherford’s ex-husband Giersch, whose U.S. visa had been revoked. “But he didn’t bother”, she tells Us.
“We are pleased that the American judicial system has prevailed”, Giersch’s attorney Fahi Takesh Hallin told ABC News in a statement.
“The kids didn’t seem to look like they missed a beat … they kissed their mother goodbye”, he added.
“In worldwide cases, what matters the most is where the kids are resident, and you saw those kids, they’re going to school, they have friends, they’re bilingual”, she said. Everything was done very civilly.
Our initial top priority should be to safeguard my children. “I have decided that I can not lawfully send my children away from the United States to live in a foreign country”, she wrote.
‘In addition, his stance of promoting Kelly’s time with the children has not changed’.
The distraught mom-of-two would now have her hopes tied with the next court hearing, which is scheduled to take place in Monaco in September.
