Kentucky officials haven’t said whether the altered licenses are actually invalid, and the ACLU seems unsure of that itself.
One deputy clear – just the one – now gives marriage licenses to same sex couples, but the court battle isn’t over. “They did not have my authorization”, she said.
Sam Marcosson, a constitutional law professor at the University of Louisville, said such receiverships are “unusual and extraordinary”, generally reserved for situations where other legal remedies are unable to end an ongoing violation of the law. And if she can’t do that, she has to be removed from office. And while Deputy Clerk Mason’s name appeared on the licenses, the form identified him as a “notary public” instead of a deputy clerk.
