Lohan loses lawsuit against ‘Grand Theft Auto’ producers
At the time of the law suit, Take-Two Interactive maintained that the likeness there was between Jonas and Lohan was that they were both “young, blonde women” and that Lohan’s suit was “filed for publicity purposes”.
On Thursday, Lindsay Lohan lost her fight against the markers of popular video game Grand Theft Auto. The latter was quickly proven false however, with sources stating a real-life model was used for the character in question.
Karen Gravano, a star of the reality show “Mob Wives”, also sued the game-maker, contending that a character that seemed to be based on her violated her right to privacy.

An official statement detailing the decision asserts that both cases are to be dismissed because Grand Theft Auto V is a satirical work of fiction, and does not fall under the statutory definitions of advertising or trade.
The actress claimed that her image was used as the basis of one of the game’s characters, Lacey Jonas.
The First Amendment to the US Constitution prohibits, amongst other things, “abridging the freedom of speech”.
As a result, Lohan went after “Grand Theft Auto” publisher Take-Two Interactive in court. Finally, Lohan argues that defendants used her portraits and voice impersonation in a character that is introduced to the player in a “side mission”. But Lohan issued a 67-page complaint, including 45 pages of evidence, to back up her claim.
The law is meant to prevent a company using a person’s likeness or voice for advertising or trade purposes when no consent has been given – something Lohan believed Rockstar was in breach of.
Ultimately, however, a five-judge panel ruled that the suits were without merit because Lohan and Gravano’s actual names and images are not used in the game.
