MA Proposes 21 Age Limit for Paid Fantasy Sports
In spelling out her approach, Healey stated what is already obvious to many: there is no intellectually honest distinction to be drawn between daily fantasy sports and other games that have been addressed under gambling laws.
Six months later, however, with NY attorney general Eric Schneiderman trying to shut down both DraftKings and top competitor FanDuel from operating in the Empire State, attorneys for DraftKings have stated in multiple legal filings that the company “operates with careful attention” to the Unlawful Internet Gambling Enforcement Act of 2006.
FanDuel – a leading player in the United States fantasy sports business – suspended entry to paid contests for people located in NY pending the outcome of a court hearing next week. Healey’s office announced the rules today after a week of deliberation, according to Boston-based WCVB-TV.
Disney’s ESPN garnered the most ad dollars from the fantasy sports networks, followed closely by Fox (NASDAQ:FOX) sports.
Healey’s office will file the draft regulations with the secretary of state’s office Friday, and will accept public feedback on the proposal through January 22. Inc. of Boston and FanDuel Inc. of NY would continue.
According to Evans, he won the money at the end of October playing fantasy sports on the DraftKings website.
Texas Attorney General Ken Paxton should take note of what his counterpart in NY did regarding increasingly popular fantasy sports sites like DraftKings and FanDuel.
Yahoo, which expanded from season-long fantasy sports into daily games in July, said on its site that it was continuing to take bets from NY users.
“We also welcome the opportunity to work with attorney generals in all states, along with other lawmakers, to implement fair regulations that benefit both consumers and sports tech innovators”.
This comes on the heels of New York’s recent cease and desist order slapped on FanDuel and DraftKings.
The MA attorney general wants to ban anyone younger than 21 from playing daily fantasy sports and impose a host of regulations on the industry. “Jason firmly believes that all of DraftKings” games are “games of skill’ that comply with all applicable State and Federal law and therefore do not violate UIGEA”. But Baker has also acknowledged that regulations might be needed.
“There is a very small subset of professional players who use sophisticated software and algorithms and through their experience, through their expertise, are in fact able to win the vast majority of these contests”, said Healey, who said she has not tried the games herself. Daily fantasy’s lawyers will argue the most successful fantasy players boil down several factors, including game history, quality of opponents and tendencies, to arrive at a safe prediction – “the best decision possible”, Grove says – of how players will logically perform.
