At the trial Friday, the child was with his dad, Michael Tarala, and appeared to be confused why he was there, the Connecticut Post reported.

The boy was the only defendant named in the case. She had sued Sean for $127,000. Unfortunately, due to Connecticut law, the homeowner’s insurance company could not be identified as the defendant.
Jainchill & Beckert said Connell, a 54-year-old human resources manager from New York City, is being attacked on social media and has “been through enough”. She didn’t want to do this anymore than anyone else would.
The boy was celebrating his eighth birthday when spotted his aunt and came running over, the station reports.
“All of a sudden he was there in the air, I had to catch him and we tumbled on to the ground, I remember him shouting, ‘Auntie Jen I love you, ‘ and there he was flying at me.”
Apparently, that was the day that shattered Jennifer Connell’s life forever.
Connell’s claim was thrown out of court in just 25 minutes.
Commenting on the impact the injury has had on her life, Connell said that she did not complain at the time but that her life has been “very difficult” since the injury because of “how crowded it is in Manhattan”. “I live in Manhattan in a third-floor walk-up so it has been very hard”, she said in court.
Connell’s attorney claimed that “a reasonable eight year old under those circumstances would know or should have known that a forceful greeting such as the one delivered by the defendant to the plaintiff could cause the harms and losses suffered by the plaintiff”.
